Terms and Conditions

Definitions:

“Windscreen replacement service provider” means the person or company who provides a windscreen replacement service to you, including any authorised representative of that person or company;

“Authorised Representative” means an employee of the windscreen replacement service provider who is authorised by them to act on their behalf in providing a windscreen replacement service;

“Windscreen” means a transparent glass panel that covers the front of your vehicle and protects it from flying debris such as dust, dirt, rain etc.;

“Service Provider” means the person who provides the windscreen replacement service to the customer;

“Customer” means the person whose windscreen has been replaced;

“Vehicle” means a motor vehicle (including a trailer) used for transporting goods or passengers;

The Customer agrees to pay the Service Provider for the windscreen replacement service provided to him/her.

The Service Provider will provide the windscreen replacement service at no cost to the Customer if the following conditions are met:

  1. The Customer informs the Service Provider within 24 hours of receiving the invoice from the Service Provider;
  2. The Customer pays the full amount due to the Service Provider before the windscreen replacement service begins;
  3. The Customer does not cancel the windscreen replacement service within 48 hours of the start of the windscreen replacement services;
  4. The Customer signs the invoice given to them by the Service Provider;
  5. The Customer accepts the terms and conditions set out in this document;
  6. The Service Provider may charge the Customer for any additional costs incurred by the Service Provider in connection with the windscreen replacement service; and
  7. The Service Provider may refuse to provide the windscreen replacement services to the Customer if they believe that the Customer is unable to comply with these terms and conditions.

The Service Provider shall be entitled to charge the Customer for any damage caused to the Vehicle during the windscreen replacement service.

The Service Provider reserves the right to change the price of the windscreen replacement at any time without prior notification to the Customer.

The Service Provider will undertake all reasonable care and diligence to ensure that the windscreen replacement service is carried out safely and efficiently. However, the Service Provider cannot guarantee that the windscreen replacement will be completed successfully.

The Service Provider will use only genuine parts supplied by the manufacturer of the windscreen. If the windscreen needs replacing because of damage caused by the Customer, the Service Provider will replace the damaged part with another part of similar specification.

The Service Provider will carry out the windscreen replacement service using the most appropriate method available to them. This may include removing the windscreen from the Vehicle and replacing it with a new one.

The Service Provider will make every effort to complete the windscreen replacement service in a timely manner but will not be liable for any delay in completing the work.

The Service Provider will not be responsible for any loss or damage to the Vehicle while the windscreen replacement service takes place.

The Service Provider will repair or replace any defective parts found on the windscreen after the windscreen replacement service has been completed.

The Service Provider will inform the Customer when the windscreen replacement service will take place.

The Service Provider will give the Customer a copy of the final invoice as soon as possible after the windscreen replacement has taken place.

The Service Provider will accept no responsibility for any loss or damage resulting from the windscreen replacement service being carried out.

The Service Provider will refund the Customer’s payment in full if the windscreen replacement service fails to meet the Customer’s expectations.

The Service Provider will return the Customer’s vehicle to its original condition upon completion of the windscreen replacement service and will pay for any necessary repairs required to restore the Vehicle to its original condition.

The Service Provider will indemnify the Customer against any claims made by third parties arising out of the windscreen replacement.

The Service Provider will also indemnify the Customer against all costs, charges, damages, losses, liabilities and expenses (including legal fees) suffered by the Customer due to any breach of this agreement by the Service Provider.

These Terms and Conditions are governed by Australian law. Any dispute relating to these Terms and Conditions must be resolved through arbitration in accordance with the arbitration act 2017.
